Hi, this is Wagoner attorney Stuart Ericson. We are gonna talk about the crime of kidnapping. So not one you hear all that often, but it does happen. I have seen it charged, sometimes even in a dating relationship-type situation. So again, fact-specific, always need to know what the facts are.
But the elements under state law of kidnapping are unlawful seizing or confining or abduction of another person with the intent to confine them, imprison them, and basically keep them against their will. You’re holding them against their will where they are not free. Those are the elements of kidnapping. It is a felony and there has to be some sort of, yeah, confinement. So some fact indicate that they are not free to get away and then that force or the effort of the defendant is used to keep them in a place away from being free. So again, another crime that’s very fact specific.
Understanding the Elements of Kidnapping

And then that’s where you hammer out a defense or a plea bargain and just decide the best course of action to go forward.
