Hi, this is Wagoner Attorney Stuart Ericson. We will go through some of the misdemeanor crimes and crimes against the person. So one of the first ones is assault and battery. Kind of simple, everybody knows the two words, but assault is different than battery, and assault and battery are also different.
Assault is the attempt or offer of force or like the threat of using force, the threat of physical violence. The battery is the actual contact, like if you are punched in the face and physical contact is made, that is the battery part. So if you’re threatening, the assault, and then you do the punch, that’s assault and battery. All of those are misdemeanors.
Punishment for Assault and Battery
Assault and battery is a misdemeanor offense in Oklahoma. If convicted, the maximum punishment is 90 days in the county jail. So if you get in a fight, only use your fists, hands, and legs, that’s going to be a misdemeanor, assault, and battery.
You know, other things, if weapons are involved or, you know, different fact scenarios, that may get you into a felony situation, but simple assault and battery is a misdemeanor with a maximum punishment of 90 days in the county jail.
