Understanding the Specific Elements of Shooting Crimes
This is Oklahoma lawyer Stuart Ericson. We’re again talking about crimes against the person. This time we’re going to look at a big one, shooting with intent to kill.
So, shooting with intent to kill is fairly straightforward. There’s three elements to that crime, intentional and wrongful. Shooting of another person or discharging a firearm with the intent to kill any person. So, three very specific elements of the crime. You intend to shoot, you know, at another with a gun with the intent to kill them.
So, what’s not shooting with intent to kill? Shooting up in the air, shooting to miss, those would be, you know, assault with a dangerous weapon or some other crime, but it wouldn’t be shooting with intent to kill. You know, the state of Oklahoma, the prosecution would have to prove that you are firing the gun with the intent to kill them, not just to harm them, to hurt them, but to kill them. And that’s not always easily proved.
Factors to Consider in Shooting with Intent to Kill Cases
Again, it’s always going to be fact specific. There’s all kinds of different fact scenarios that I’ve seen and heard of and been involved in, you know, shooting into a crowd, shooting at somebody, but there’s other people present. You can get into ideas of transferred intent if you intend to shoot somebody, but end up shooting somebody else. All very fact specific, all very serious crimes, ones you would have to discuss with a criminal defense attorney.
