The Powerful Defense of a Defensive Alibi
This is Oklahoma attorney Stuart Ericson. Let’s talk about just some defenses and we’ll do more over time on these but one you always hear on the TV and movies is alibi, defensive alibi.
So in that case it’s evidence that’s been reduced that the defendant was at another and different place at the time of the commission of the crime charge. So basically a crime is committed Thursday night at 10 p.m. somehow you are accused and you would have to give notice of a defensive alibi to the state of Oklahoma and have evidence of that but basically you’d be saying I’m innocent I wasn’t there at that time at that location at that place at that time to have committed this crime I was over here and presumably you would have witnesses or some evidence that you were somewhere else.
Let’s say you were at the movies with a group of people you have your ticket stub for that time and day you’re in the movie you’re around people that can say yeah he never left the theater and the movie was over at a certain amount of time it’s way after the crime that would be the defensive alibi.
Using a Defensive Alibi as a Defense
Now of course to use the defense it means that the state doesn’t really agree with it you’re still being charged and you’re still headed all that way so a defensive alibi is obviously a complete acquit if the jury believes your alibi defense you will be acquitted. So it is a very powerful defense that usually requires some pretty good strong evidence other than you know yourself just saying hey I wasn’t there I didn’t do it. Other evidence would be a lot more effective and we would always work on that to see what there actually is as far as that.
